Illinois - Chicago COVID-19 Employee Protections and Paid Sick Leave Amended

On May 20, 2020, the Chicago City Council enacted an ordinance (No. SO2020-2343) prohibiting employers from retaliating against covered employees complying with public health orders that require them to (or when caring for another must):

  • Stay at home to minimize the transmission of COVID-19;
  • Remain at home while experiencing COVID-19 symptoms or sick with COVID-19;
  • Obey a quarantine order or isolation order issued to them by their treating healthcare provider; and
  • Obey an order issued by the Commissioner of Health regarding the duties of hospitals and other congregate facilities.

No. SO2020-2343 also made changes to the paid sick leave portions of the city’s Minimum Wage and Paid Sick Leave Ordinance by redefining covered employees to include the following (who were not previously covered):

  • Outside salespersons;
  • Religious organization members;
  • Student employees of an accredited Illinois college or university; and
  • Federal or state regulated motor carriers.

Of note, on May 12, 2020, the city also updated its paid sick leave to include mandatory notice requirements. The sick leave law is effective July 1, 2020.
