New York - Call Center Jobs Act

On January 2, 2020, New York Governor Andrew Cuomo signed legislation (S.B. 1826) requiring call center employers to provide prior notice of relocation of call center jobs from New York to a foreign country or any other state. Call center employers are business entities with 50 or more employees, excluding part-time employees; or 50 or more employees that in the aggregate work at least 1,500 hours per week, excluding overtime hours, for the purpose of staffing a call center.

Specifically, call center employers must notify the New York Labor Commissioner of a relocation at least 100 days prior when they plan to either:

  • Relocate a call center from New York State to a foreign country or any other state; or
  • Reduce call volume handled at call centers in New York State by at least 30 percent, measured as the call volume of the previous calendar month compared to the average monthly call volume of the previous 12 months, and intend to relocate such operations from New York State to a foreign country or any other state.

The law is effective June 30, 2020.
